WIN A CAR COMPETITION
1. PROMOTER
1.1 The promoter of this promotional competition ("Competition") is RETAILABILITY (Trading as Edgars) ("Promoter").
1.2 The Competition is conducted in accordance with Section 36 of the Consumer Protection Act, 68 of 2008 ("CPA"), and Regulation 11 of the Consumer Protection Act Regulations.
2. COMPETITION PERIOD
2.1 The Competition commences at 00:01 on 20 July 2026 and closes at 23:59 on 15 September 2026 ("Competition Period").
2.2 No entries received before or after the Competition Period will be eligible.
3. ELIGIBILITY
3.1 The Competition is open to all natural persons who:
a) are residents of the Republic of South Africa;
b) are 18 years of age or older at the date of entry; and
c) possess a valid South African identity document, passport, or legally recognised proof of identity.
d) A valid South African driver's licence is not required to enter the competition. However, the vehicle prize may only be collected and driven away by an individual who holds a valid South African driver's licence. If the winner does not possess such a licence, they may nominate a licensed individual to collect and drive the vehicle on their behalf.
3.2 The following persons may not participate in the Competition:
a) directors, members, partners, employees, agents, consultants, or immediate family members of the Promoter;
b) suppliers of goods or services directly connected with the Competition;
c) any person who directly or indirectly controls or is controlled by the Promoter; and
d) any person involved in the administration, management, auditing, verification, or oversight of the Competition.
4. HOW TO ENTER
4.1 NEW ACCOUNT HOLDERS
To qualify for entry, a customer must:
a) successfully open and activate an Edgars store account, powered by RCS, during the Competition Period.
To qualify for additional entries, a customer must:
a) make a qualifying purchase of R500 or more in a single transaction using the account in any Edgars store in the Republic of South Africa or on the Edgars online store (www.edgars.co.za), during the Competition Period.
4.2 EXISTING ACCOUNT HOLDERS
To qualify for entry, an existing Edgars account holder must make a qualifying purchase of R500 or more in a single transaction in any Edgars store in the Republic of South Africa or on the Edgars online store (www.edgars.co.za) during the Competition Period.
4.3 Each qualifying transaction of R500 or more constitutes one entry into the Competition.
4.4 Multiple entries are permitted. Each separate qualifying transaction of R500 or more will generate an additional entry.
4.5 Returned goods, cancelled transactions, fraudulent transactions or reversed purchases will not qualify for entry.
4.6 Accounts in arrears, under administration, debt review or fraud investigation at the date of the draw will result in disqualification of the relevant entry.
4.7 There is no separate entry fee to participate in the Competition.
5. THE PRIZE
5.1 The prize consists of one (1) motor vehicle:
JAECOO J5 CORE, 2026 MODEL, (Colour subject to availability) VALUED AT R346,452.51 (R339,000 plus delivery, carpets & paint valued at R5,697.83)
5.2 The prize is not transferable, refundable, exchangeable, or redeemable for cash.
5.3 The Promoter reserves the right to substitute the prize with a prize of equal or greater value should circumstances beyond its reasonable control make this necessary.
5.4 All licensing, registration and delivery arrangements relating to the vehicle shall be communicated to the winner at the time of prize notification. The prize does not include insurance for the vehicle - this must be arranged by the winner.
6. WINNER SELECTION
6.1 The winner will be selected by a random draw from all valid entries received during the Competition Period.
6.2 The draw will take place on or before 30 September 2026.
6.3 The draw will be overseen and certified by an independent attorney, advocate, registered auditor, or accountant as required by Regulation 11.
6.4 The independent overseer shall verify the fairness and integrity of the draw process and certify the outcome.
7. WINNER NOTIFICATION
7.1 The provisional winner will be contacted using the contact details recorded on the Promoter's systems.
7.2 The Promoter will make at least three reasonable attempts to contact the provisional winner over a period of ten (10) business days.
7.3 If the provisional winner cannot be contacted, is found to be ineligible, declines the prize, or fails to complete the verification process within the prescribed period, the Promoter reserves the right to select an alternative winner.
8. PRIZE CLAIM PROCESS
8.1 To claim the prize, the provisional winner must, within ten (10) business days of notification:
a) provide their original South African identity document or passport;
b) provide proof of residence not older than three months;
c) provide any documentation reasonably required to verify eligibility and compliance with these rules;
d) complete and sign the Promoter's prize acceptance documentation;
e) provide proof of the qualifying transaction, if requested;
f) attend a prize handover appointment, if reasonably required.
8.2 The winner may be required to complete any statutory documentation necessary for vehicle registration and licensing.
8.3 Failure to comply with the verification requirements may result in forfeiture of the prize and selection of an alternative winner.
9. PUBLICITY AND MARKETING
9.1 The winner will be invited to participate in publicity, advertising, marketing material, social media content, photography, or promotional events.
9.2 Participation in such publicity is voluntary.
9.3 The winner may decline participation in any publicity, marketing activity, or use of their image without affecting their right to receive the prize.
10. GENERAL CONDITIONS
10.1 The Promoter reserves the right to disqualify any participant who:
a) breaches these rules;
b) provides false or misleading information;
c) manipulates or attempts to manipulate the Competition process;
d) engages in fraudulent conduct.
10.2 The Promoter reserves the right to cancel, suspend, or amend the Competition where necessary due to circumstances beyond its reasonable control, subject to applicable law.
10.3 The Promoter's decision regarding any aspect of the Competition shall be final and binding, subject to applicable law.
10.4 The Competition is governed by the laws of the Republic of South Africa.
10.5 Any dispute arising shall be directed in writing to the Promoter's designated Competition Administrator at [insert contact/email], who shall investigate and respond within a reasonable period.
10.6 If the dispute cannot be resolved to the participant's satisfaction, the participant may refer the matter to the National Consumer Commission ("NCC") or another applicable consumer protection body or ombud with jurisdiction over the matter, in accordance with the Consumer Protection Act, 68 of 2008.
10.7 The Promoter and each participant hereby consent to the non-exclusive jurisdiction of the High Court of South Africa, KwaZulu-Natal Division, Durban, in respect of any legal proceedings arising from or in connection with this Competition, without prejudice to the Promoter's right to institute proceedings in any other court of competent jurisdiction.
11. PROTECTION OF PERSONAL INFORMATION
11.1 Personal information collected during the Competition will be processed in accordance with applicable data protection legislation, including the Protection of Personal Information Act, 4 of 2013 ("POPIA").
11.2 Personal information will be used solely for purposes relating to the administration of the Competition and any related lawful business purposes.
12. AVAILABILITY OF RULES
12.1 These Competition Rules will be available free of charge:
a) on the Promoter's website;
b) and/or upon request from the Promoter.
13. RECORD KEEPING
13.1 The Promoter shall retain all records relating to the Competition for a minimum period of three (3) years following the conclusion of the Competition.
13.2 Such records shall include the Competition rules, marketing materials, prize details, winner information, draw records, and oversight certification as required by the CPA and Regulation 11.
14. TAX RESPONSIBILITY
14.1 The Promoter has obtained professional advice regarding the tax treatment of the prize.
14.2 Any tax liability arising from the acceptance, ownership or use of the prize shall be the sole responsibility of the winner.
14.3 The winner is advised to obtain independent tax advice regarding any personal tax consequences associated with receiving the prize.
14.4 The Promoter makes no representation regarding the tax implications of winning the prize and accepts no responsibility for any tax obligations that may arise.
15. DELIVERY AND COLLECTION OF THE PRIZE VEHICLE
15.1 Following successful verification, the Promoter shall arrange delivery of the Prize Vehicle through an authorised Jaecoo dealership within the Republic of South Africa.
15.2 Delivery shall occur within sixty (60) business days of successful completion of the winner verification process, subject to vehicle availability.
15.3 The winner may be required to collect the Prize Vehicle from a designated authorised dealership nominated by the Promoter.
15.4 The winner must present:
a) Original South African Identity Document or passport;
b) Proof of residence;
c) Valid driver's licence. A valid South African driver's licence is not required to enter the competition. However, the vehicle prize may only be collected and driven away by an individual who holds a valid South African driver's licence. If the winner does not possess such a licence, they may nominate a licensed individual to collect and drive the vehicle on their behalf;
d) Any documents required for registration and licensing.
15.5 Ownership shall transfer to the winner upon completion of the handover process and signature of all required documentation.
15.6 Risk in the Prize Vehicle shall pass to the winner immediately upon handover.
15.7 If the winner fails to take delivery of the vehicle within thirty (30) days after being notified that the vehicle is available, the Promoter may deem the prize forfeited and select an alternative winner.
16. ALTERNATIVE WINNER SELECTION
16.1 The Promoter shall draw no fewer than three (3) reserve winners during the original draw process.
16.2 Reserve winners shall remain confidential unless activated.
16.3 A reserve winner may be selected if:
a) The original winner is ineligible;
b) The original winner cannot be contacted;
c) The original winner fails verification;
d) The original winner declines the prize;
e) The original winner breaches these rules.
16.4 The reserve winners shall be contacted in the order drawn.
16.5 Each reserve winner shall be subject to the same verification requirements as the original winner.
17. PROCESSING OF PERSONAL INFORMATION (POPIA)
17.1 By entering the Competition, participants acknowledge that the Promoter may collect, process, store and use personal information for purposes directly related to the administration of the Competition.
17.2 Personal information may include:
a) Name and surname;
b) Identity number;
c) Contact details;
d) Account information;
e) Purchase information;
f) Prize fulfilment information.
17.3 Personal information shall be processed in accordance with the Protection of Personal Information Act, 4 of 2013.
17.4 Personal information shall not be sold to third parties.
17.5 Personal information may be shared with service providers involved in administering the Competition, including RCS, auditors, attorneys, prize fulfilment providers, marketing agencies and authorised dealerships where necessary for legitimate Competition purposes. The sharing of personal information with RCS is governed by the existing Store Card Agreement between Retailability and RCS, which sets out the lawful basis, purpose limitation, security safeguards and breach notification obligations applicable to that data sharing.
17.6 Participants may request access to, correction of or deletion of their personal information, subject to applicable law.
18. FRAUD PREVENTION AND AUDIT PROVISIONS
18.1 The Promoter reserves the right to verify all entries.
18.2 The Promoter may require additional documentation to verify any participant's eligibility.
18.3 Entries associated with fraudulent transactions, reversed transactions, stolen identities, account abuse, system manipulation, collusion or suspected unlawful conduct shall be disqualified.
18.4 The Promoter may conduct internal and external audits of all entries.
18.5 The Promoter reserves the right to withhold the prize pending investigation of suspected fraud.
18.6 The Promoter may disqualify any participant where reasonable grounds exist to believe that the participant has acted unlawfully or contrary to these rules.
18.7 The Promoter's fraud investigations may include transaction validation, account verification, identity verification and purchase verification.
19. INDEPENDENT OVERSIGHT AND CERTIFICATION
19.1 The Competition shall be conducted under the supervision of an independent registered auditor, admitted attorney or advocate as contemplated in Regulation 11 of the Consumer Protection Act Regulations.
19.2 The independent overseer shall:
a) Review the Competition mechanics;
b) Monitor the draw process;
c) Verify the integrity of the winner selection process;
d) Verify compliance with applicable legislation;
e) Certify the Competition outcome.
19.3 The independent overseer shall prepare a written report confirming that:
a) The Competition was conducted fairly;
b) The draw process was random and impartial;
c) The winner was selected from valid entries;
d) The Competition complied with the Consumer Protection Act and Regulations.
19.4 The certification report shall be retained with the Competition records for not less than three years.
“WIN R10 000 WORTH OF DENIM COMPETITION” – TERMS & CONDITIONS (SA ONLY)
1 INTRODUCTION
1.1. The “Win R10 000 Worth of Denim” Competition (“Competition”) is organised and run by Edgars (“the Organiser”).
1.2. By entering the Competition and/or accepting any prize, all participants (“participants”, “entrants”, “you” or “your”) agree to be bound by these terms and conditions (“Rules”).
1.3. Copies of these Rules are available online at https://www.edgars.co.za/.
2 COMPETITION PERIOD
2.1. The Competition commences on 15 June 2026 and closes on 31 July 2026.
2.2. Edgars reserves the right to amend, modify, suspend or terminate the Competition at any time, without prior notice.
3 WHO CAN ENTER
3.1. To be eligible to enter the Competition, you must:
3.1.1. be an existing Edgars ThankU Member;
3.1.2. be a legal and permanent resident of the Republic of South Africa;
3.1.3. be in possession of a valid South African identity document containing a 13 (thirteen)-digit identity number;
3.1.4. be 18 (eighteen) years of age or older at the time of entry;
3.1.5. be a natural person; and
3.1.6. not be barred or disqualified by any authority from taking delivery of the prize or any portion thereof.
3.2. Notwithstanding clause 3.1, you may not enter the Competition if:
3.2.1. you are a director, member, partner, employee, agent or consultant of the Organiser, or any other person who directly or indirectly controls or is controlled by the Organiser; or
3.2.2. you are a supplier of goods or services in connection with the Competition.
4 HOW TO ENTER
4.1. Purchase any ladies’, men’s or kids’ denim item in-store or online at Edgars during the Competition Period.
4.2. Ensure that you are a registered Edgars ThankU Member.
4.3. Eligible denim purchases will automatically qualify as entries into the Competition.
5. PARTICIPATING BRANDS
5.1. All Edgars Private Label and International Brands are participating in this Competition.
6 DETERMINATIONS OF WINNER
6.1. One winner will be selected.
6.2. The winner will be selected at random from entrants who:
a) are registered ThankU Members; and
b) purchased any denim item during the competition period.
6.3. The winner will receive R10 000 worth of denim products of their choice.
6.4. The winner will be notified via telephone or email using the contact details linked to their ThankU profile.
6.5. If the winner does not respond within 48 hours of being contacted, the Promoter reserves the right to select an alternative winner.
7 PRIZE
7.1. The winner will receive R10 000 worth of denim products from Edgars.
7.2 Prize cannot be exchanged for cash. Winner of the Prize will be contacted and notified via phone call. The winner/s may be required to provide the following documentation: a valid SA ID copy, a photographic image of themselves to be published on all sponsors social media pages. If required, the potential winner will have 48 hours to submit the relevant documentation before forfeiting the prize. Failure to do so will result in a disqualification.
8 GENERAL TERMS
8.1. The prize is non-transferable and cannot be exchanged for cash.
8.2. By participating, entrants agree to abide by these terms and all decisions made by Edgars, which are final.
8.3. The Organiser may in its sole discretion amend these rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised rules on the website.
8.4. The Organiser will interpret the rules in their sole discretion and reserve the right to amend the rules at any time should it be deemed necessary in the sole and unfettered discretion of the organisers.
8.5. If you are not eligible to enter the competition in terms of clause 3 above, you will forfeit any prize that may be allocated to you in terms of this competition. The organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time, you will be disqualified, and any prizes will be forfeited and returned if applicable.
8.6. The organiser may collect, store, and use any personal information of entrants and/or other participants for communication or statistical purposes. By entering the competition, you expressly consent to the aforesaid use.
8.7. In the event of a dispute, the decision of the organiser will be final, and binding and no correspondence will be entered into. In this regard and for further clarity, the organiser shall be entitled to deal with such disputes (or any failure by participants to follow the rules) in their sole discretion, including that the organiser shall be entitled, in addition to any other rights which the organiser may have in terms of these rules and/or the general competition rules, to immediately disqualify participants from this competition.
8.8. By entering the competition and/or accepting any prize, the entrants, users and/or winners hereby indemnify, release and hold harmless the organiser (including its subsidiaries, holding companies and affiliates), its directors, employees, agents, suppliers and contractors (the “organiser parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim or damages of any kind resulting in whole or in part, directly or indirectly, from participation in the competition, and/or the use, acceptance or possession of a prize, and/or participation (or non-participation) in a prize-related activity.
8.9. The organiser reserves the right to terminate the competition at any time with immediate effect. If this is the case, the organiser will provide a notice on the website. It shall be the responsibility of entrants to review such website in this respect. In such event, all entrants hereby waive any rights which they may have against any of the organiser parties and acknowledge that they will have no recourse or claim of any nature against the organiser parties.
8.10. All personal information you provide to us will only be processed (as such term is defined in the protection of personal information act, no 4 of 2013 (the “act”)) for the purposes of the competition and otherwise in accordance with the provisions of the act. In this regard, all personal information you provide to us will be treated in accordance with our privacy policy. Your personal details will not be published on the site (unless agreed otherwise) or sold to any third party.
8.11. The organiser is not liable for any technical failure that may result in an entry not being successfully submitted.
8.12. Any prize is accepted by a winner at his/her own risk and the organiser is not liable, at any time, for any defect in the prize.
8.13. Where relevant, if a Winner does not accept the Prize as required herein, if an entry is not valid for whatever reason, if a Winner has breached these terms and conditions, if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Winner.
8.14. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit, or avoid any rights or obligations created for either the entrants or the organisers in terms of the Consumer Protection Act, 68 of 2008.
8.15. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the various marketing communications.
8.16. This competition is in no way sponsored, endorsed, or administered by participating brands.
8.17. This Competition is valid and open to participants within the Republic of South Africa only.
